First Level Appeals
First Level Appeals are the first step in appealing one of the following:
- Inspection (Report) Notices
- Correction Notices
- Life/Safety Violations
First Level Appeals are reviewed internally by the Code Director. Please fill out the attached online form, clearly stating which of the following criteria the appeal is based upon:
- The true intent of the code or the rules legally adopted there under was incorrectly interpreted; or
- The provisions of the code do not fully apply; or
- An equivalent form of construction is to be used.

Second Level Appeals
Second Level Appeals occur when an appellant wishes to appeal the decision rendered by the Code Director within a First Level appeal. Second Level Appeals are heard by the Code Board of Appeals (Appeals Board). The Appeals Board consists of licensed professionals with engineering, architectural, and building construction expertise within the region. The intent of having a professional, regional Appeals Board is to provide uniform interpretation of the codes.
Second Level Appeals:
- Shall be legally advertised and conducted according to the Pennsylvania State Sunshine Act;
- Within an enforcement action, Second Level Appeals must be received within thirty (30) calendar days of receipt of a written decision to a First Level Appeal.
The Appeals Board shall only consider the following factors when deciding an appeal:
- The true intent of the act or Uniform Construction Code was incorrectly interpreted.
- The provisions of the act do not apply.
- An equivalent form of construction is to be used.
The Appeals Board may consider the following factors when ruling upon a request for extension of time or the request for variance:
- The reasonableness of the Uniform Construction Code’s application in a particular case.
- The extent to which the granting of a variance or an extension of time will pose a violation of the Uniform Construction Code or an unsafe condition.
- The availability of professional or technical personnel needed to come into compliance.
- The availability of materials and equipment needed to come into compliance.
- The efforts being made to come into compliance as quickly as possible.
- Compensatory features that will provide an equivalent degree of protection to the Uniform Construction Code.
The Appeals Board shall provide written notice of its decision to the appellant and the Code Director.
An appellant wishing to appeal the decision of the Appeals Board, regarding the Property Maintenance Code, shall do so to the Municipal Council/Board of Supervisors in the appropriate Municipality.
An appellant wishing to appeal the decision of the Appeals Board, regarding the Uniform Construction Code, shall do so within the Commonwealth Court System.
