Shared Land Use Study

The Centre Region Shared Land Uses Study provides information on how the Centre Region municipalities could potentially share land uses across municipal boundaries. The Pennsylvania courts have ruled that every municipality that chooses to utilize zoning to control the location and density of land uses must provide for every lawful land use within its boundaries. However, municipalities that participate in a multimunicipal comprehensive plan are authorized by the Pennsylvania Municipalities Planning Code (MPC) to plan for land uses throughout the entire planning area. The ability to plan and provide for uses throughout the multimunicipal planning area provides legal protection against substantive validity challenges and allows land uses to be distributed in a way that fits with the existing and desired character of the community.
